Copy of CCO letter on grant of grade pay of Rs.5400/- to Inspectors

what is the point ,no progress is taking place in case of granting of 5400/- grade to acp insp.! pay cell is mumon the issue and on verbal enquiry they say will do only after green signal from officers i.e.CAO! WHY !THIS is ridiculous and shameful even due salary is being denied to insp. who will pay the interest for delayed period!

Dear Kaushik,

It is quite shoking to find that cbec has taken a summersault in the matter of 5400 gp by not allowing 5400 gp to 4 year acp inspector. this will effect more to Inspector posted in maharastra, M.P and chhattisgarh as even 1987 batch of inspector are still waiting promotion. so while who have joined department as inspector in 1992 in other zone will get 5400 gp, the inspector of these zone even of 1987 will get 5400 after 4 year of actual promotion. The regional imbalance of promotion was earlier bear by Inspector as there was no pay imbalance due to ACP. but this latest sumnmer sault will spread unrest among those Inspector.

You need to take urgetn and immediate action in this matter and if required, judicialry may be apprached in the light of ACP scheme.

Comrade,

We can adopt a twin pronged strategy. The Association would represent to the Board for a review of the instructions. Simultaneously individuals can move the CAT.

While pursuing the issue we should not restrict the case to the interpretation of the resolution alone. The case should be based on the 99 ACP scheme wherein the the purpose of the ACP is to give the financial benefit that would accrue on promotion. It is also specified that that on actual promotion after receipt of ACP, no further fixation would be granted.

The competency of the Expenditure Department in clarifying the issue is also doubtful since ACP is within the realm of DOPT.

We plan to file OA in Kerala by next week. I would appreciate that initaiatives done in other states may also be communicated for effective co-ordination

Hi all

Considering the ambiguous nature of the CBEC letter dated 21-11-2008, I have been taking the RTI route in the matter of settling the issue of Rs. 5400 GP once for all. I took the following steps:

1.On 03-12-2008, I wrote to CPIO, CBEC for obtaining copies of references/letters sent to Dept of Expenditure, asking for letter(s)/ reference(s) they made to Dept of Expenditure and the reply/clarification received from the DoE in the matter of grant of 5400 GP to Gr B officers ( Pl remember the letter dated 21-11-2008, which says, they have referred the matter to DoE and got clarification)

2. My letter was returned by CPIO, CBEC on the pretext that the authority I had specified in the Indian Postal Order was ” the Accounts Officer” and that I have to remit either cash of made a DD/IPO favoring ” Section Officer(cash)” or ” Pay & Accounts Officer”. The concerned CPIO who signed this letter is AShri. S.K.Deb Under Secretary.

3. I had conveyed my protest and quoted the RTI Act and Rules as well as a decisions of CIC in the matter and re-applied vide letter dated 27-12-2008, with a DD favoring ” Pay& Accounts Officer”. I also told them that I reserved my right to take up the rejection of my RTI application form at the appropriate forum at tha appropriate time.

4. On 05-02-2009 I received a letter from CPIO, CBEC stating that the concerned file F. No. A26017/98/2008-Ad.IIA is “under submission” and that reply would be given when the file is received back. the letter is signed by one Shri. Alok Agarwal, Under Secretary, Ad.IIA

5. Till today (23-02-2009), no reply is received from CBEC.

6. However on 11-02-2009, a further letter is seen issued in the said file ( the same file in which the earlier letter dated 21-11-2008 is issued), by Alok Agarwal. This letter denies 5400 GP to ACP Inspectors..

7. This proves that the file is available with the concerned CPIO, at least during the period up to 11-02-2009.

8. So I filed an Appeal u/s 19(1) of the RTI Act with the Appellate Authority Shri. LR Agarwal, on 19-02-2009. the Appeal prays for supply of information as well as for conducting a proper enquiry on the whole matter and action against the two Under Secretaries.. The Appellate authority under RTI is the same person who have signed the CBEC letter dated 21-11-208, so I think, I will have to take Second Appeal with CIC also.

9. If you go through the letter of CBEC dated 11-02-2009, there is no reference to the letter dated 21-11-2008.I seriously suspect ’something is rotten in Denmark’.

10. I have scanned copies of all the above correspondence. If anybody requires the same, I am willing to send them by mail..

Hi all

Thanks for all your appreciation. I just wanted to ‘clear the air’ on this issue. Our cadre has following genuine grievances:-

1. Notional up-gradation of the scales from 01-01-1996. While some posts/cadres were given notional up-gradation from 01-01-1996, our cadre along with some other were denied this given benefit prospectively from 21-04-2004 for no justifiable reason. This matter can be resolved by following means. Write RTI application to DoPT as well as DoE requesting information in respect of all posts/cadres up-graded from 5500 to 6500 scale and 6500 to 7500 scale. What are their reasons for up-gradation of all these posts/cadres as well as for notional fixation of some of the posts/cadres? Were any posts given retrospective arrears? Why? Always ask for reasons written in file. Never ask for opinion, which will be promptly denied. Please remember that ‘babus’ were playing with our careers earlier because they never expected something like RTI Act (It is the most wonderful act passed by Our Parliament). Try to “fix responsibility”. “babus should find it easier to give in to our genuine grievances, rather than fight our combined wrath in litigation. Also, my request to all would be, not to approach Hon’ble CAT/ High Court etc. They are waiting for us to do some such foolish things to take shelter under the excuse ” the matter is sub-Judice”. See the case of promotion of Appriasers. Recent promotion to ACs excluded Appriaser cadre as their seniority is under litigation. This matter will naturally clear the issue of grant of Grade Pay of Rs. 5400/- to Supdts, who have completed four years before 21-04-2008.

2. Grant of Rs. 5400 grade pay to ACP Inspectors. Try to file RTI application with CBEC, DoE as well as DoPT for documents. Try to find some friends in CSS Assistant cadre who are airing grant of Rs.5400 GP to ACP Assistant also. Assistant Cadre has more voice in Delhi so try to find a mutual alliance for mutual benefit. Our friends in Delhi can take up this issue.

3. Last, but not least, is why PB-2 instead of PB-3 like others granted Rs. 5400 after four years. This is will give benefit only to those, whose band pay was below 15600 when upgraded Rs.5400 GP. All others, at reaching the end of PB-2 will move to PB3. This is not a serious issue.

Discrimination by creating a class within a class.The ACP holders needs more compassion than the regular promottees in a particular cadre- because the former is stagnating. By instant interpretation the officials have added insult to injury- because you are not promoted so you shall not have the grade pay of 5400. An Inspector who is stagnating for 20 years for no fault of his is being made to suffer more where as his colleague posted in a commissionerate who gets promotion after 12 years is being soothed further by enhanced grade pay. This injustice is being perpetuated by narrow interpretation of the law without having gone into ramifications /consequencies. We as a cadre certainly need to educate some of the babus who are oblivious of the pangs of stagnating in a cadre for 20 years.Why we need to undertake this excercise is because no one else has better qualifications than us– as no one stagnates more than us.
