DRAFT TRANSFER POLICY DULY ACCEPTED BY ALL THE STAFF ASSOCIATION'S OF CUSTOMS & CENTRAL EXCISE JAIPUR ZONE

Dear friends,

A copy of the draft policy, that has been signed/accepted by all the staff Association’s during the meeting dated 05.02.2009 with the Joint Commissioner (Cadre Control), office of the Chief Commissioner, Jaipur Zone is being placed below for member’s information. The same is likely to be finalized.

Commissionner of Central Excise Jaipur I & II, suggested to reduce the tenure of Bhilwara, Chittor and Sikar from 4 to 3 year, we welcome this suggestion.
As discussed with the Commissioner of Customs, they are seeking approwal from the CC Cus(P) to reduce the tenure of customs.
As per the JC(CCO) AGT order’s may be issued before 15th March, 2009.

DRAFT TRANSFER POLICY DULY ACCEPTED BY THE ASSOCIATIONS OF GROUP ‘B’ (SUPERINTENDENTS & INSPECTORS), ‘C’ AND ‘D’ STAFF WORKING IN THE CUSTOMS AND CENTRAL EXCISE COMMISSIONERATES, JAIPUR (RAJASTHAN) IN VIEW OF BOARD’S LETTER F.NO.A.35017/02/ 2008-AD.IIIB DATED 31.10.2008

I- STATION TENURE: -

For the purpose of Annual General Transfer (AGT) the tenure of posting at a particular station in respect of Supdt. and Inspectors will be as follows: -

1. Jaipur – 5 years.
2. All Central Excise Divisional Hqrs except Jaipur & Bhiwadi – 4 years.
3. Bhiwadi – 3 years
4. All Central Excise Ranges/ Sectors situated outstation of the Divisional Hqrs – 2 years.
5. Customs Divisions Bikaner & Sriganganagar – 2 years.
6. All Customs Ranges, LCS Munabao, the ICDs, Narcotics Cells at places other than at Jodhpur & Jaipur and Customs Divisions Barmer, Jaisalmer – One year (A period of not more than one month less than the period elapsing between two consecutive AGTs at border station)
7. All other postings in Customs – 2 years

The tenure at Central excise and non border Customs stations could be extended or reduced as per administrative convenience/ exigency or requirement of postings in Customs with explicit approval of the Chief Commissioner. Those considered for extension beyond the normal station tenure to be assigned non-sensitive charges only except where non-sensitive charges are non existent. In the case of an officer on promotion continuing at the same station, his tenure at that station in the post previously held by him shall also be taken into account for computing the total tenure at that station.

II. ALLOCATION OF COMMISSIONERATE:

After completion of tenure at Customs Border Station, an officer shall be posted to Central Excise formation. The officers identified for Border postings in the cadre control order shall essentially be posted to such places by the Customs. The substitute of the officers due from Customs border will be provided from the Central Excise and non-border Customs postings after completion of station tenure. Officers of the age above 56 years will not be posted at Border stations.

The following sequence of priority shall be adopted for Border posting** in Customs.

a. Volunteers.
b. Officers with nil exposure including fresh recruitments irrespective of completion of tenure at a place. But in respect of promotee officers, their postings in previous grades shall be considered as valid exposure.
c. Officers completing tenure at a station in Central Excise and also Non-Border Customs.
d. In case of excess availability the officers with less Border Postings in their entire career irrespective of grade in which they served, shall be given preference. In case of less availability, the officers with the longest stay at a station shall be preferred. In case of availability of officers of equal exposure of Border Posting, the one with longer exposure in Central Excise & Customs non-border postings at a stretch shall be given preference.

** All postings in Customs Ranges except at Udaipur and Customs Divisions except Jodhpur.

The officers who are due from Customs will be allocated to Central Excise Commissionerate Jaipur-I and Jaipur-II on the basis of their previous posting in Excise.

The options of the officers shall be considered, as far as possible.

III General:

1. Annual General Transfer should be completed before the end of March.
2. For the purpose of deciding as to whether a particular officer has completed his station tenure or not at a station will be counted from AGT to AGT.
3. After allocation of staff to the respective Central Excise/ Customs Commissionerates, further specific posting of staff within the Commissionerates/ Divisions will be made by the jurisdictional officers within 15 days of issue of AGT from cadre control in the light of Ministry DO No. C-50/30/2000-AdII dated 15.07.2002. The tenure at any post will not exceed two years at a stretch, except with explicit approval of Chief Commissioner.
4. Respective jurisdictional Commissioners of Customs & Central Excise will also have full authority/ power to transfer an officer on administrative grounds without effecting change in station. However, explicit approval of the Chief Commissioner (JZ) will be required for transfers involving change of station without completion of tenure within a Commissionerate.

IV LOCAL ROTATION AT A STATION:

(a) The local rotation of officers between Central Excise and Customs will be done on the basis of longest tenure in Central Excise subject to availability of vacancy in Customs.
(b) Posting of officers in Central Excise, Jaipur-I & Jaipur-II shall be made on the basis of their exposure in respective Commissionerates.
(c) Officers posted in Service Tax Ranges be rotated to Central Excise Ranges after a year.

V SENSITIVE CHARGES:

As per circular No. 1/2000 dated 10.05.2000 issued by the DG (Vig), New Delhi, sensitive charges are required to be identified with reference to Group ‘B’, ‘C’ and ‘D’ officers. The following charges are considered as sensitive:

IN CENTRAL EXCISE (for two years )

1. All Central Excise and Service Tax Ranges
2. Preventive/Anti Evasion Sections of Headquarters and Divisions
3. Refund/Rebate Sections of the Divisions.
4. Internal Audit Section
5. All deputations.

IN CUSTOMS

1. Preventive Section of Jaipur and Jodhpur
2. ICDs
3. ACC
4. FPO
5. Customs Range Churu

After completing their tenure in a sensitive charge for a year, an officer will be required to be rotated to a non-sensitive charge.

Ministerial Cadre

Ministerial officers are also liable to be transferred to anywhere in the jurisdiction of the Zone. However, frequent transfers of Ministerial Officers should be avoided and their local rotation may be considered at the time of AGT, on the following criteria:

a) Local rotation from Excise to Customs & vice versa: on completion of 2 yrs in Customs and having longest tenure in Excise.
b) Local rotation from Excise to Excise at Jaipur on completion of 4 yrs in the Commissionerate.

Group ‘D’

Group ‘D’ officers are also liable to be transferred to anywhere in the jurisdiction of the Zone. However, frequent transfers of Group ‘D’ Officers should be avoided and their local rotation may be considered at the time of AGT, on the following criteria:

c) Local rotation from Excise to Customs & vice versa: on completion of 4 yrs in Customs and having longest tenure in Excise.
d) Local rotation from Excise to Excise at Jaipur on completion of 4 yrs in the Commissionerate.

Miscellaneous :

1. As far as possible officers who are due to retire within two year or so, may be transferred/posted to the places where they propose to settle down after their retirement.

2. Lady officers should be posted, as far as possible, to the stations where their families are residing, in case the officer specifically makes a representation for extension of station tenure.

3. As regards, the transfer of office bearers of recognized Unions/Associations, the instructions contained in DOPT’s O.M. No. 27/03/69-Estt (D) dated 08.04.69 read in consonance with its O.M. No. 27 (7)88-CS-IV dated 19.08.1988 should be observed as far as possible.

Any deviation from the policy so enunciated could be relaxed only with explicit approval of Chief Commissioner.

It is good to see some changes in the policy. From the policy, it appears that there will be one year tenure at Cus.(Prev.). The same does not appears to be good considering the work of investigation which requires lots of time to understand the case and to complete it . In a 1 yr. of span, no body bothered to book the case, investigate it and finalize it and leave it to others and last will suffer. For the person involved in investigations, tenure should be 2yrs. for other 1 yrs. . Further, there is nothing above the persons who prematurially transferred to their choice of place and get the sensitive posting straight away. Like the deputation has been treated as sensitive, persons on tranferring on choice should be posted to non sensitive for atlease 2 yrs..Further local rotation from excise to excise on completion of 4 yrs in the commissionerate will give only 1 yr. at division office, it is require to be atleast 2 years. Moreover, for local rotation there should not Jaipur-I or Jaipur-II rather it should be Customs & Excise so that the officers of Jaipur-II commissionerate posted at Jaipur should be transferred to division office in rotation as there is not enough sensitive post for II commissionerate.
In last all the policies are good if implemented with good will which is being done to good extent for last some years.This ratio is required to be increased if office bearer left their interest aside.
