Subject: Promotions against the existing vacancies of Asstt. Commissioner.

Madam,

Kindly refer to the various communications of the Association addressed to the administration including Ref. No. 219/11 Dt.13.12.11, 163/11 Dt. 12.09.11, 139/11 Dt. 16.08.11, 102/11 Dt. 6.07.11, 100/11 Dt. 01.07.11, 91/11 Dt. 22.06.11, 85/11 Dt. 08.06.11, 71/11 Dt. 20.05.11 etc. as well as the letter F.No. A-32021/42/2011-Ad.II Dt. 01.11.11 of CBEC asking for the relevant information from the field formations till 25.11.11.

2.      The Association is thankful to the authorities for taking initiative in the matter. It is further submitted with due regards that your goodself is already aware of the retirement of a good number of our officers every month and 10% of the officers out of the list enclosed with the above referred letter F.No. A-32021/42/2011-Ad.II Dt. 01.11.11 would be retired upto 31.12.11 without promotion. In view of the above referred letter of the Board, the Association and our officers were expecting that the promotions of the eligible officers would certainly be affected at least in the month of December’11. But it is submitted with great disappointment that nothing such seems to be happened.

3.      As talked to the concerned Director week ago, it was told to the Association that the UPSC itself would conduct the DPC for these vacancies and the Board is going to call for the ACR dossiers of the concerned officers from the field formations for the purpose. But nothing happened in the last week to that affect too and the issue is going to be delayed & delayed despite of the repeated requests of the Association. The Association was assured by the administration a year ago that the DPC for the existing promotional vacancies of Asstt. Commissioner would be held at least twice in a year keeping in view the large scale retirements of our officers. This assurance was given because the preparation of the advance panel as per DOPT directions was not possible on account of the ad hoc promotions. The advance panel can only be made for the permanent vacancies.

4.      A scheme of ‘in-situ promotions’ also originated a year ago certainly benefitting at least all the retiring officers. But the final fate of the said scheme is still awaited. The Association came to know that there were some internal arguments against the scheme that it would disturb the inter-person relationship. Such type of arguments only seems a pretext for not implementing the scheme. No such problem is being faced at any place under the scheme wherever it is already in the existence and it is serving the every wanted good. The ‘Rajya Sabha’ model of the scheme seems an ideal one for our organization.

5.      It is also submitted that no direct recruitment would be made for more than 2 years as per the decision taken during the presentation made on the cadre restructuring on 18.01.11. After that also; the minimal direct recruitment would only be made, if et al required. Moreover, the Hon’ble Supreme Court has given the directions to remove the disparities in promotions to group ‘A’ from group ‘B’ on 03.08.11 implying that more number of vacancies would be given to Central Excise after reviewing all the ad hoc promotions on the basis of new Recruitment Rules. It is, therefore, requested that all the vacancies against retirements for coming at least 2 years may be given to the Central Excise personnel in addition to the existing vacancies and the DPC may be held accordingly.

6.      In view of the above, it is requested that-

i) the conducting of DPC for the promotions against existing vacancies of Asstt. Commissioner may kindly be expedited and the promotions may be materialized at an early date.
ii) the in-situ promotions scheme may also be formulated and implemented as early as possible to give a bit solace to the officers retiring without promotion.

Subject: Proposed revised Recruitment Rules as per the verdict given by the Hon’ble Supreme Court on 03.08.11 in Civil Writ Petition No. 385/10.

2. It is further submitted with due regards that the Association has got no response/communication on the issue till the moment while the last date to frame final recruitment rules as directed by the Hon’ble Supreme Court is very close, i.e., 31.12.11. The recruitment rules were to be framed to ensure the just & fair representation of each category of stake holders on the basis of their past and presentation representations.

3. As far as any change in the ratio of the feeder categories for the entry into group ‘A’ is concerned, it has already been admitted by the Board itself in its meetings of 12.01.11 and 18.02.11 that any type of altered ratio would not be able to solve the problem of the stagnation of the stagnated officers. As per DOPT norms also, ratio formula is not applicable where the number of promotional vacancies is so small, i.e., to the tune of 3% only.
4. The just and fair representation of each category, as directed by the Hon’ble Supreme Court, is possible only by bringing the common entry level counterparts at par in the matter of promotions and other benefits. As per the decision taken by the Board itself in its meeting of 12.01.11 also, the Director General of HRD was directed to suggest a scheme to eliminate the disparities in the promotions of the employees to give them equal opportunities for promotion to the group ‘A’ level. 

5. To bring all the officers of a particular year joining as Inspector of Central Excise, Preventive Officer of Customs and Examiner of Customs to the same level of promotion was also committed by the Board during the presentation made on the cadre restructuring on 18.01.11 saying that the matter is under examination.

6. The reduction of direct recruit quota of group ‘A’ officers was also very much expected in view of the proposal of the Board itself that the half of the direct recruit quota would be shared by the promotee officers for merit based entry. But nothing has been done in that regard.

7. No provisions have been proposed to abide the new rules to all the ad hoc promotions, i.e., retrospective implementation of the rules.

8. No provisions have been proposed to merge grade VI and V keeping in view that a grade VI officer has to enter the grade V automatically after completion of 4 years of service in time bound manner.

9. No provisions have been proposed to ensure that no senior of Central Excise has to work under his/her junior of Customs. Under the present circumstances, a Central Excise officer senior even by 20 years has to work under 20 years junior of Customs and this gap may be widened even more after the implementation of cadre restructuring. The Board has itself admitted in its meeting of 18.02.11 that the 1992 Examiner has already entered group ‘A’ while the 1975 Inspector is still to enter group ‘A’. The Board has also admitted in the meeting of 12.01.11 that the fresh vacancies likely to arise as a result of cadre restructuring may not be able to resolve the problem of stagnation being faced by this category. Thus, all of the Examiners & Appraisers will certainly retire as Commissioner or even above (6 or more promotions) while only some of the Inspectors & Superintendents of Central Excise (1979 Inspector) will be able to enter JTS level of group ‘A’.
 
As far as the CSS is concerned, 1997 Assistants have become Under Secretary (equivalent to our Deputy Commissioner) and they generally reach the level of Director. A good number of them also enjoy the post of Joint Secretary on in-situ basis.
As far as the CBDT is concerned, 1992 Inspectors have become Asstt. Commissioner and they generally reach the level of Additional Commissioner. Some of them also reach the level of Commissioner.

10. Nothing has been done to remove the stagnation of Central Excise officers either in the last or ongoing cadre restructuring despite of the DOPT communications like D.O.No.5/26/2010-CS.II(A) Dt. 06.10.10, No. 19/1/2008-CS.I(P) Dt. 20.07.10, No. 20/51/2009-CS.II Dt. 27.01.11, No.35034/9/2010-Estt.(D) Dt. 10.02.11etc. stipulating very clearly that the cadre restructuring process should be viewed to mitigate the stagnation of the stagnated employees.

11. No heed has also been paid to the latest OM No. AB-14017/61/2008-Estt.(RR) dt. 24.03.09 of DOPT which clearly stipulates the promotion of Inspector completing 12, 17 & 20 years of service to the grade of JC, ADC & Commissioner respectively. This was also admitted by the Board itself during the presentation of cadre restructuring proposal on 18.01.11 but was said not to be possible to implement due to the want of required number of vacancies. The Board never countered the provisions of the said OM of DOPT even a little. It is, therefore, requested that the new recruitment rules may kindly be framed for the Inspectors & Superintendents of Central Excise in consonance of the qualifying services as mentioned in the above referred DOPT OM No. AB-14017/61/2008-Estt.(RR) dt. 24.03.09 in the following manner– 

(i) 2 years for promotion to a post with a grade pay of Rs. 4,800/- after joining as Inspector.

(ii) 7 years for promotion to a post with a grade pay of Rs. 6,600/- after joining as Inspector (There is no justification of promoting an officer from a grade pay of Rs. 5,400/- to 5,400/-. It is also mention-worthy that the most of the group ‘B’ gazetted officers including in CSS are being promoted to a senior group ‘A’ post instead of junior group ‘A’.).
(iii) 12 years for promotion to a post with a grade pay of Rs. 7,600/- after joining as Inspector.
(iv) 17 years for promotion to a post with a grade pay of Rs. 8,700/- after joining as Inspector.
(v) 18 years for promotion to a post with a grade pay of Rs. 8,900/-after joining as Inspector.
(iv) 20 years for promotion to a post with a grade pay of Rs. 10,000/- after joining as Inspector.
(v) 23 years for promotion to the HAG after joining as Inspector.
(vi) 24 years for promotion to the HAG + Scale after joining as Inspector. 
(vii) 26 years for promotion to the HAG Apex Scale after joining as Inspector. 
(viii) 27 years for promotion to the HAG + Apex Scale after joining as Inspector.

In addition to the above qualifying services and keeping in view the acute stagnation of the Central Excise stream officers, there should kindly be incorporated the permanent provisions in the recruitment rules at every level to promote the officer automatically to the next higher grade, if his/her stagnation in a grade reaches one & half times of qualifying service. It may also kindly be ascertained in the recruitment rules that a direct recruit Inspector of Central Excise is not retired before entering PB4 pay band like other common entry counterparts. The measures like time bound promotions, notional promotions, direct promotion to higher post/s, creation of super-numeratory posts, creation of separate service (as also recommended by the IRS officers Association) etc. may also kindly be taken into consideration to improve the acutely stagnated condition of these officers. A time bound mechanism to grant the time scale after every 7 years was also recommended by the Board itself to 6th CPC which may be reflected in the recruitment rules now.


12. In view of the above; it is requested that the recruitment rules may kindly be framed accordingly even seeking some special relaxations from the concerned authorities, if required. The Association has always requested for the parity with other counterparts and never with the IRS officers. This parity is certainly attainable, if it is possible for IRS officers. It is also worth to submit that it is very well possible for our Board. As talked to DOPT authorities, only the CBEC has the powers to frame the rules for the purpose of parity with our counterparts.

13. Without being prejudice to anybody/anything; it is further submitted with complete humbleness that the Superintendents of Central Excise would have no way left but to act as per the legal advice of the legal expert/s, if the wanted result is not attained till 31.12.11 and the recruitment rules are not finalized accordingly.

2. It is again submitted with due regards that a proposal to formulate an in-situ promotions scheme was initiated by CBEC a year ago on the request of the Association keeping in view the acute stagnation in the Central Excise executive stream. The proposal was initiated independent of cadre restructuring and was intended to give at least monetary parity in promotions with the other counterparts. It is worth to submit that the Examiners of 1992 have already become Asstt. Commissioner and the Examiner of 2006 will become Asstt. Commissioner in 2012 after cadre restructuring. They will retire as Commissioner or even above after that, while only some of the Inspectors of1979 will be able to enter JTS level of group ‘A’ at the fag end of the career.
 
As far as the CSS is concerned, 1997 Assistants have become Under Secretary (equivalent to our Deputy Commissioner) and they generally reach the level of Director. A good number of them also enjoy the post of Joint Secretary on in-situ basis.

As far as the CBDT is concerned, 1992 Inspectors have become Asstt. Commissioner and they generally reach the level of Additional Commissioner. Some of them also reach the level of Commissioner.
 
3. The in-situ promotions to the officers joining at the level of Inspector were proposed as follows under the proposal- 

i) As Superintendent after 10 years of service. 
ii) As Asstt. Commissioner after 20 years of service.
iii) As Deputy Commissioner after 25 years of service.
However against S. No. iii), the period of 25 years should have been replaced by 24 years keeping in view that an Asstt. Commissioner becomes automatically Deputy Commissioner within 4 years as a time bound mechanism. 

4. The features like counting of in-situ service for further promotions in group ‘A’ were also the part and parcel of the proposal.

5. It is further submitted that this unique administrative scheme for in-situ promotions was started in 1999 in CSS to remove the stagnation of the Section Officers (analogous counterparts of the Superintendents of Central Excise) by giving promotion to all the officers completing one and half of qualifying service required for the purpose. Since then, it is a part & parcel of stagnation removing mechanism in CSS as 40 posts of Joint Secretary have been demarcated under the scheme for the promotee officers in the latest cadre restructuring of CSS. Not only CSS, this scheme is being adopted to promote the officers even upto the highest levels in various organizations/departments. 

6. As far as our organisation is concerned, it is an admitted fact that the Inspectors and Superintendents of Central Excise are the most stagnated category of the government employees. The latest model of in-situ promotion scheme of Rajya Sabha seems to be the best suited one to give the employee the opportunity to reach the higher levels. Such a model may also be considered to compensate our Central Excise officers a bit at least in terms of pay matters and retirement benefits. It is also well pertinent to mention that likewise recommendations were also sent to the VIth CPC by our Board to grant time-scale after every 7 years to the officers. Thus, an unique in-situ promotion scheme may be formulated as a combination of Rajya Sabha model and recommendations made by our Board to 6th CPC.

7. No actual efforts have been made for Central Excise officers to improve their promotional avenues hitting the stagnation either in the last or ongoing cadre restructuring. It has already been admitted by the Board that the proposed posts of the AC’s/DC’s would also be insufficient to remove the stagnation of these officers. Also, there exists no legal hindrance for the Board to adopt this unique mechanism. It is further worth to submit that every organistion has formulated this scheme in accordance of its requirement to compensate its employees against stagnation. Our Board is also free and has each power to formulate a scheme to give benefit to its stagnated employees.

8. In Rajya Sabha, this sheme has been adopted to give the opportunity to the lower employees to reach the penultimate level of the organisational hierarchy. The initial step of the Rajya Sabha scheme is like below-

“A person holding a post in any grade (Superintendent grade in our case of CBEC) may be promoted to the next higher grade in his/her line of promotion on in situ basis on completion of 8.5 years of service in the grade in which he/she is working or 13.5 years of combined service (Inspector+Superintendent in our case of CBEC) in the grade in which he/she is working and the grade immediately lower to that, whichever is less.” 

The period of 8.5 or 13.5 years may be reduced accordingly in our case keeping in view that our group ‘B’ gazetted officer is promoted merely to a junior group ‘A’ post (grade pay of Rs. 5400/-) while a group ‘B’ gazetted officer in Rajya Sabha Secretariat and CSS etc. is promoted directly to a senior group ‘A’ post (grade pay of 6600/-)

9. Like that, an unique scheme may also be adopted in our organisation to benefit the stagnated employees. It will certainly help the good number of our officers retiring on monthly basis without promotion independent of cadre restructuring. 

10. It is also worth to submit that this scheme would require no creation of fresh vacancies and also no expenditure because all the Superintendents completing 4 years of service are already getting a grade pay of Rs. 5400/-.

11. As also observed by the High Power Committee in Para 4.25, the Government in other departments have addressed the need for removal of stagnation in staff cadres by introducing in situ promotions.

12. The Parliamentary Standing Committee on Home Affairs in its 83rd Report on Personnel Policies of CSS and CISF has also recommended in para 7.13 -7.14 (page 29) that grant of ACP should not stop grant of in situ promotions to stagnated Assistants. Likewise, same is the case of MACPS or ACPS for the Inspectors/Superintendents of Central Excise.

13. The Association came to know that there were some internal arguments against the scheme that it would disturb the inter-person relationship. Such types of arguments don’t seem correct and justified because no such problem is being faced at any of the places under the scheme wherever it is already in the existence. In turn, it is serving the every wanted good everywhere.

14. In view of the above, it is requested that the scheme may kindly be expedited accordingly independent of and implemented before the cadre restructuring giving it retrospective effect w.e.f. 01.01.06 on account of acute stagnation being faced by the Superintendents of Central Excise for decades. It is also worth to submit that all the Superintendents completing 4 years of service on 01.01.06 are already getting a grade pay of Rs. 5400/- again putting no financial burden on the government to implement the scheme.

Subject: Disparities in the pay structures of Superintendents and Inspectors in the Customs & Central Excise Settlement Commission on deputation basis. 

Madam,

It is submitted with due regards that the Superintendents and Inspectors of Central Excise are posted as the Senior Investigating Officer and Junior Investigating Officer respectively on deputation basis in the Benches of Customs & Central Excise Settlement Commission all over the country.
2. Previously, the Superintendents and Inspectors used to draw their salaries in the scale of Rs. 6500-200-10500/- and Rs. 5500-175-9000/- respectively. Accordingly, at the time of inception of the Settlement Commission in 2003, the pay scales of the Senior Investigating Officer and Junior Investigating Officer were notified as Rs. 6500-200-10500/- and Rs. 5500-175-9000/- respectively.
3. Later on, in terms of the CBEC F.No. A/26017/65/2003-AD-II (A) dt. 22.04.04, the pay scales of the Superintendent and Inspector were upgraded to Rs. 7500-250-12000/- and Rs. 6500-200-10500/- respectively w.e.f.21.04.04. But the pay scales of Senior Investigating Officer and Junior Investigating Officer in the Settlement Commission were not upgraded at par with Superintendent and Inspector. This disparity could not be noted at that time because the Superintendents and Inspectors were officiating as the Senior Investigating Officers and Junior Investigating Officers respectively on deputation basis in the different Benches of Customs & Central Excise Settlement Commission with their pay protected as per the then existing rules and regulations.
4. Subsequently, in the wake of the report of the 6th CPC as accepted by the Govt. of India, all such pay scales stand redefined w.e.f. 01.01.06 as furnished in a nut-shell as below:- 
Pay scale prior to 01.01.2006 Revised pay structure w.e.f 01.01.2006 in terms of 6th CPC Report
Rs. 7500-250-12000/- PB-2 (Rs. 9300-34800/-) with the initial Grade Pay of Rs. 4800/- and Grade Pay of Rs. 5400/- (NFG) after completion 4 years of regular service in the grade of Superintendent.
Rs. 6500-200-10500/- PB-2 (Rs. 9300-34800/-) with the Grade Pay of Rs. 4600/- 
Rs. 5500-175-9000/- PB-2 (Rs. 9300-34800/-) with the Grade Pay of Rs. 4200/-

5. But, since the pay scales of the Senior Investigating Officer and Junior Investigating Officer in the Settlement Commission were not upgraded in terms of the above-mentioned F.No. A/26017/65/2003-AD-II (A) dt. 22.04.04 of CBEC vis-a-vis the up-graded pay scales of the Superintendent and Inspector, the disparities in the light of the 6th CPC Report in the pay structures of the Senior Investigating Officer (deputation post for Superintendent) and Junior Investigating Officer (deputation post for Inspector) in the Settlement Commission w.e.f. 01.01.06 are observed as follows:-

6. In this regard your kind attention is also drawn to Clarification 5 (i) of the Office Memorandum F.No. 1/1/2008-IC dt. 13.09.08 issued by the Director, Ministry of Finance, Department of Expenditure (Implementation Cell) wherein it is categorically mentioned that in case a Govt. servant goes on deputation to a post carrying a lower grade pay, his pay in the pay band would continue to be unchanged, but he will be granted the grade pay of the lower post for the entire duration of the deputation.

7. So as to say that the grade pays of the Superintendent and Inspector would be reduced, if they are appointed as Senior Investigating Officer and Junior Investigating Officer on deputation basis in the different Benches of Customs & Central Excise Settlement Commission.

8. Owing to the above mentioned pay-disparities, the Superintendent and Inspector of Central Excise are not willing to opt for the posts of the Senior Investigating Officer and Junior Investigating Officer on deputation in the Customs & Central Excise Settlement Commission inspite of repeated notifications/circulars inviting option for such deputation posts. As a result, our members (i.e., Superintendents of Central Excise) are not being able to avail of the scope for serving the Settlement Commission on deputation as Senior Investigating Officer as well as not getting any assisting hand as Junior Investigating Officer there.

9. In view of the above, it is requested that the above disparities may kindly be undone to enable the officers under CBEC to opt for the said deputation posts.
