In a letter issued by the Deputy Secretary (Ad.IIIB), Department of Revenue, Ministry of Finance vide F.No. A.60/13/RTI/2006-Ad.IIIB dated 26.05.2006,it was clarified that the regular service for the purpose of first financial up-gradation under the ACP scheme will commence from the 1st July of the year following the year of examination in respect of direct recruitment and from the 1st July of the select List year in respect of promotee/ departmental examination candidates.
Basis of that clarification, Chief Commissioner (Cadre Control) of Customs & Central Excise Jaipur Zone was represented first by the Customs & Central Excise Executive officers Association Rajasthan vide letter C.No. CCEEOA /JPR / Rep. / 2007 / Dated- 05 .03.2007 and IInd time by the AICEIA Rajasthan vide letter C.No. CCEEOA /JPR / Rep. / 2009 / Dated- 30.04.2009.
Later on, the matter was also represented by the All India Inspectors & Superintendents Association separately, before the board. Against the agenda point no.7 to the minutes of CBEC Chairman’s meeting dtd.12,13 &14 July,2011 with the Supdt. Association, it was informed that CBEC letter dtd.26.05.2006 will be implemented in cases covered by the rules.
Now the CBEC vide letter F.No.A-12034/65/2011-Ad.III B dtd. 08.11.2011, in consultation of DOPT clarified that officers of Group B & C of the CBEC are not covered by the said RTI reply dtd.26.05.2006. The DOPT clarification is totally discriminatory and Board clarification also has no statutory force.
