Suggestions invited by the CBEC on Current Transfer Policy

Dear friends,

The Administration vide letter C.No. II-3(18)CCO/JZ/ET/2008 dated 12.11.2008 has called for the comments on Para 3(b) of the CBEC letter DO F.No.A.35017/02/2008-Ad.IIIB , dated 31st October,2008 regarding Transfer Policy for the Group "B","C" & "D" officers by 17.11.2008. Text of the CBEC letter dated 31.10.2008 is placed below.

As such, it is requested to all the members to sent the suggestions for change/ modifications in the Transfer policy ,points, if any, in writing/ telephonically / personally through any of the Office Bearer /Executive Member of the Association.

Dear Sir/Madam,

This is regarding the Transfer Policy of the Board for Group-B,C &D officers.The Transfer policy/Guidelines for Group-B,C &D officers,were issued by the Board vide Circular No.F.No.A35017/28/92-AdIII-B dated 30.06.1994.A copy of the same is enclosed herewith for your ready reference.

2. The Board has been receiving complaints from Staff Associations regarding non -compliance of the Transfer Policy guidelines in the same Zones.Further,some staff Associations have also suggested that the Transfer policy guidelines of 1994 need revision.The issue also came up in the meeting/interaction of the Chairman,CBEC with recognised Staff Associations on 25-26 September,2008.After deliberations,it was decided that the provisions of the current Transfer Policy should be examined in consultations with the field formations and the Associations and the matter should be placed before the board within 3 months along with suggestions received from the field formations and the Associations,for deliberations and decision.

3. In the above context,I would request you to kindly furnish the following information in order to enable us to take further steps in this regard.

a) Most of Zones have formulated detailed Transfer Policy guidelines,consistent with broad policy guidelines contained in the Board's circular of 1994 referred in Para-1 above.A Copy of such transfer Policy being followed in your Zone may kindly be furnished. Also,it may be indicated whether the Transfer policy was framed in consultation with the Staff Associations. Any deviation from the Board's policy guidelines may also be pointed out along with reason thereof.

b) Suggestions,if any,for change/modification in Board's Transfer Policy guidelines of 1994 in the light of experience so far.

There is request, any comments received from members via any mode may be put on the site. So that all members can see these. As far the Transfer policy is concerned it should be for a particular period not like 3 or 4 years for a particular station. It should be instant.

The following points/suggestions for JCM/Transfer policy are being forwarded from Customs Division Barmer

1. The tenure of Customs Division Barmer should be made one year instead of the existing two year due to the following reasons:

As you would be aware that the Inspectors posted at Barmer are deputed to attend LCS duty at Munabao two to three times every month. The Inspectors posted at LCS Munabao who have been posted specifically for LCS duty also perform duty thrice a month as they get exemption once (sometimes twice also) a month and in this way the number of duties performed in a year by the staff at LCS Munabao is almost equivalent to the staff posted at Barmer.

Similarly the Inspectors posted at other stations namely Gadra Road, Chohatan, and Sanchore also attend LCS duty two to three times every month.

However the station tenure of these stations namely LCS Munabao, Gadra Road, Chohatan and Sanchore is only one year and the staff posted at these places are transferred within a year whereas the staff posted at Barmer who perform almost equivalent LCS duties in a year have to remain in Barmer for two years and have to attend LCS duty for two years which makes the number of duty performed by the staff of Barmer double in comparison to the number of duties performed by the staff posted at other stations. Moreover the staff at Barmer also has to attend to other regular work of the Division office on the rest of the week days.

It is also a well known fact that though Barmer is a District Headquarter yet it is not a very good family station as there is no good educational and medical facility available and therefore most of the staff members (95 % staff) do not bring their family and live alone in Barmer.

Thus you will agree that the above points are very valid reasons for reducing the tenure of Barmer to one year

2. It is suggested that the staff posted at Munabao must be given training to apprise them of the basic Baggage Rules, X-Ray, the manner of checking and the basic nature of work at Munabao so that new Officers who are posted at Munabao may carry out their work smoothly and properly. It is also felt that facilities for staff at Munabao must be increased. Arrangement may be made to provide food from the canteen set up at Gadra Road for the staff coming for LCS duty from far of places. Better facilities for enabling officers to rest properly may also be made at Munabao.

3. At present officers who are performing LCS duty are allowed to avail only two CCLs at a stretch in lieu of duty performed on Saturday/Sunday. It is suggested that an officer who does not avail CCL every week may be allowed to avail at least FOUR CCL together.

4. The association must take interest to get new posts sanctioned for Service Tax as the workload is increasing and the officers are burdened with heavy workload and are under very much pressure and working in stress.

5. It is taking more than 18 years for an Inspector to get his first promotion whereas those entering at either IRS level or at TA level are able to get very fast promotions. Such late promotions increase frustration and affect the morale of the officers. The matter must be taken up and not only DPCs should be convened at the earliest but some other steps for increasing the promotion opportunity for Inspectors must be looked into.

6. Apart from the above it is felt that a fair policy of transfer should be adhered to. It is seen that many officers who have never been to border or have very less border tenure still manage to avoid border posting whereas others who have been to border twice and have completed three or more years are again given border posting which clearly indicates that there is something wrong with the system. It is also suggested that those who are due from border should be posted, as far as possible, at their hometown or to a place of their choice.

The AICEIA fully agree with the issue, the issue is being taken up with the administration.


Regarding pay arrears, Instruction were issued by the government to make payment of Ist installment by October, 2008.

On being pointed out, matter regarding payment of pay arrears to barmer staff has been taken up with the customs administration yesterday. I hope that this will resole by today itself.
