Points takenup for discussion in the meeting dt.04.11.08

ALL INDIA CENTRAL EXCISE INSPECTORS’ ASSOCIATION

POINTS FOR DISCUSSION WITH THE HON’BLE CHIEF COMMISSIONER, CADRE CONTROL (JZ) ON VARIOUS LOCAL ISSUES PENDING WITH ADMINISTRATION IN THE MEETING DATED 04.11.2008

1. Case of victimization of office bearer - A case of victimization of an Inspector by the administration on the basis of false / misleading information was brought to the notice of administration on 5.09.2008. Factual position with regard to the issue was also brought to the notice of Hon’ble Chief Commissioner on 12.09.2008. A Request for granting a second audience for resolving the matter was turned down by administration on 23.09.08 and it was informed that the agenda may be submitted in writing. Therefore, the facts which had already been brought to the notice of administration have been re-iterated in writing along with copies of all the relevant documents on 30.09.2008.

Since two months period has already elapsed, matter referred to Vigilance section has been returned at preliminary stage due to non sustainable allegations, but the victimized officer is still waiting for justice. Therefore, the Association once again requests to cancel the said order of pre-mature transfer for imparting justice to the victimized officer.

2. Discontinuation of Control room duties;- The control room in Jaipur is being maintained by the Department without any clear-cut authority of law as appears from the information provided by the CBEC in response to an RTI application of the All-India Federation of Central Excise Executive Officers. The information further reveals that duties of control room officers are not mentioned anywhere, as no rule or authority of functioning of control room have been prescribed. Many Central Excise Commissionerates have either stopped allotment of Control Room duties completely or kept the control room operative only during the working hours of the day. Enforcement Directorate has assigned the Control Room duties to ex-servicemen from the private security agencies. Officers of the rank of Sepoy/ Hawaldars are being deputed for Control Room duties in the DRI.

Therefore, it is requested that allotment of control room duties to inspectors of central excise be stopped forthwith to prevent wastage of manpower or kept the control room operative only during the working hours of the day.

3. Wearing of Uniform during desk duty;-The circular dated 26.06.2008 issued by the Joint Commissioner (P&V), Central Excise-I, wherein it was directed that officers shall come to office dressed in the prescribed uniform on all Wednesdays has subsequently been withdrawn vide the circular dated 15.07.2008 and it has been clarified by the worthy Additional Commissioner in the meeting dated 16.07.2008 with the Association, that it is not the intention of the administration to ask the officers to wear uniform every working day, even on Wednesday. The intention of the administration is to ensure that officers keep their uniforms properly maintained at all times and wear the same as and when they are asked to do so by special orders on ceremonial occasions/ special duties/ field duties requiring wearing of uniforms. However, it has come to the notice of the Association that in some cases, inspectors have been called for explanation for non-wearing of uniform during the desk duty. In such a situation concerned officers feel targeted and such type of act by the administration only evoked a feeling of humiliation and strong resentment amongst the Cadre.
Therefore, the concerned AC/DC’s may be directed to pay regard to the intention of the administration.

4. DPC for promotion to the cadre of Superintendents;- The Central Board of Excise & Customs vide Office Order No. 217/08 dated 10.09.2008 issued promotion from the cadre of Superintendent of Central Excise to the cadre of Assistant Commissioner. This has given rise to 6 vacancies in the cadre of Superintendents in Jaipur Zone.The cadre controlling authority has been requested by the Association on 29.09.2008 to convene a DPC for filling up these vacancies.

However, a period of 35 days has passed but positive response is still awaited. Even no reasons for delay in conducting DPC have been communicated.

5. Non forwarding of proposals for Cadre Restructuring of the Department submitted by the Association- In compliance to the DOPM’s Memorandum F.No.5/12/ B/O&PM/ 2006 dated 12.06.2007 forwarded through CCU letter C.No. II-39(2) CCU/JPR/2007/4260 dated 13.09.2007 inviting suggestions/ comments from Staff Association, detailed proposal for creating three additional commissionerate in Jaipur zone were prepared & submitted to the Chief Commissioner, Customs & Central Excise Jaipur Zone, Jaipur on 09.10.2007 with a request to examine the proposal and forward their favorable comments to the DOPM. The administration had also recommended creation of new commissionerates.

However, in minutes of JCM dated 27.08.2008 issued by the ADC (P&V) Jaipur-I on 24.09.2008, it has been informed that proposals regarding 7 additional posts of superintendents for newly created Service Tax Division and 3 service tax Ranges have been forwarded by the CCU on 04.07.2008. This shows that no proposal for creation of any new commissionerate has been forwarded by the administration. The act creates humiliation amongst the members waiting for their first promotion even after putting in more than 18 years service as inspector.

Therefore, it is requested that these proposals may be forwarded to the DOPM with favorable recommendation in the light of statistical data and factual position narrated in the said proposal.

6. Deputation policy;- Issue of clear cut deputation policy was raised by the Association in JCM dated 28.05.2008. Thereafter, a committee of three ADC/JC( P&V) was constituted by the Chief commissioner to put up a draft policy in consultation of Association. Report was submitted by the committee after consultation with the Association. However, minutes of JCM dated 27.08.08 issued by the ADC (P&V) Jaipur-I vide letter dated 24.09.08 are silent about those developments.

Therefore, it is requested that the draft may be finalized and issued immediately.

On the date of visit of Mr. Kousik Roy(Secretary General AICEIA),Chief Commissioner was on tour.Therefore, all the above points have been discussed with the Commissioner-I and Joint Commissioner (Cadre Control) on the behalf of CC. Positive response has been given by the administration. results awaited.
