Ban on Inter Commissionerate Transfers of Group ‘B’, ‘C’ and ‘D’ officers relaxed by the CBEC for a period of SIX months on Spouse Ground

Dear friends,

In view of DOPT instructions contained in their OM No. 28034/7/86-Estt(A) dated 03.04.1986 as amended by OM dated 12.06.1997 and 23.08.2004) the CBEC vide letter F. No. A.22015/19/2006-Ad.III.A dated 27.03.2009 relaxed the Ban on Inter Commissionerate Transfers of Group ‘B’, ‘C’ and ‘D’ officers beyond the Commissionerate having common cadres, i.e. from one cadre controlling authority to another, without any loss of seniority, subject to the following conditions;-

a) The transfer/change of cadre shall be permissible only in cases where the spouse is employed with either the Central Government or a State Government or a Public Sector Undertaking of the Central Government/a State Government.

b) The Option for change of cadre must be exercised within six months of the initial appointment of the officer, if the officer is married at the time of such initial appointment. In case of marriage taking place subsequent to the initial appointment, the option must be exercised with in six months of marriage. Further, as far as past cases are concerned, the option must be exercised with in six month of issue of these instructions.

The issue of ICT was taken up by the All India Central Excise Inspectors Association in CHARTER OF DEMANDS submitted to the CBEC during the month of Oct.2008.
Although, the matter of ICT + seniority was never demanded , I think the ICT with seniority, will open another set of can of worms and CAT cases. All india seniority of inspectors is the only solutions.

Sir,
I would like to know that, if I am already married & working in Central Govt. & if my spouse joins the Central/state Govt. now, whether this relaxation in ICT is applicable. Also whether any time limit is there in this relaxation in ICT to get transferred?
Pls do enlighten on the above.

Can somebody guide me on following
1) whether the transfer under ICT spouse ground is available after one's spouse joins govt service after marriage?

2) whether any time limit is there for this circular?
