Subject- Suggestions on Transfer Policy for Group ‘B’,’C’ & ‘D’ officers regarding

Please refer to your office letter C.No.II-3(18) CCO/JZ/ET/2008 dated 12.11.2008 on the subject cited above.

In the matter we have called for the views/suggestions from the members of the Association and after careful consideration of the same in meeting of office bearers held on 20.11.2008, this Association requests to include the following suggestions in the existing Transfer policy;-.

1. A separate deputation policy has not yet been incorporated in the general transfer policy and therefore, there is lack of uniformity in the matter of considering officers for deputations. Deputation policy should be framed and made part of the general transfer policy, so that all eligible and willing officers may be considered for deputation and no officer is allowed to extend the prescribed tenure of deputation nor the cooling off period is normally relaxed. This will enable uniform exposure to deputation postings to maximum number of willing officers.

2. In the matter of tenure of posting in customs it was suggested by the Association vide letter C.No. CCEEOA/JPR/ Policy /2008 dated-02.04.2008 addressed to the Chief Commissioner (JZ) that instead of the proposed four years, the tenure of posting in customs should be two years. The Commissioner of Customs had agreed to the suggestion but necessary amendments in the transfer policy are yet to be incorporated.

3. It was suggested that all the Customs formations except those at Jodhpur and Jaipur should have one year tenure in view of the adverse climatic conditions of the border districts of Sriganganagar, Bikaner, Jaisalmer and Barmer, the comparative lack of facilities for quality education and other amenities at those stations and the fact that Customs work at those stations has reduced significantly in the recent past. The suggestion was accepted in respect of Customs Ranges but Division offices have not yet been covered by the one year tenure policy. It is, therefore, requested that all the Customs formations except those at Jodhpur and Jaipur should have one year tenure.

4. Presently the tenure of stay at the stations where Central Excise Divisions located is three/ four years which creates uncertainty. Hence, the tenure at all Central Excise Divisional Headquarters including Central Excise Division Jaipur should be fixed at three years.

5. Tenure of stay at Jaipur has been changed from five years to four/ five years which may be kept five years.

6. Sometimes transfers are effected beyond the scope of the tenure policy on administrative grounds and officers are posted out of a particular station before completion of the station tenure. The policy may be suitably amended to provide that while effecting transfers on administrative grounds change of station will normally be avoided as there are a variety of postings at almost all stations to enable posting of an officer on administrative grounds from a particular posting to another posting.

7. The three members committee for effecting Annual General Transfers may not be required to be constituted once clear-cut guidelines are incorporated in the transfer policy.

8. Since academic sessions of many schools come to an end on 31st day of March, annual general transfer orders should be issued by 10th of March and after considering representations, if any, the transfer orders should be made final by 25th of March.
