Sub: Discriminatory promotional avenues for Central Excise Executive Officers in CBEC.
Sir,
It is submitted with due regards that the Inspectors of Central Excise, Preventive Officers and Examiners of Customs are the analogous posts recruited through the same competitive examination under same eligibility conditions in the same organization of Central Board of Excise & Customs (CBEC) of the same Department of Revenue having same administrative hierarchy and performing same nature of job of tax collection but with huge discriminatory difference in promotional avenues (admitted by CBEC). All of those are mentioned as “Inspectors only” in the recruitment rules and other relevant documents. They get next promotion as Superintendent of Central Excise, Superintendent and Appraiser of Customs (again analogous posts) respectively at group ‘B’ gazetted level performing again same nature of job. The single cadre trifurcated at the level of Inspector is re-merged at the level of Asstt. Commissioner (group ‘A’ entry level) placing Central Excise Inspectors 2 decades behind the Examiners of Customs. The position of the Preventive officers is in between.
2. Thus, a single cadre has been trifurcated in totally discriminatory manner into 3 streams by CBEC due to which the senior Central Excise stream officers have to work under their extreme juniors (junior even by 17 years) of Customs. It `has been admitted by CBEC itself that the Examiners of 1992 batch have already entered group ‘A’ while the Inspectors of Central Excise of 1975 are still waiting to reach that level.
3. The Central Excise stream officers work in all of the three streams of the CBEC, i.e., Central Excise, Service Tax and Customs. On the other hand, the Customs stream officers work only in the Customs stream but they are posted to Central Excise and Service Tax after entry into group ‘A’. Thus, it is even more surprising that a junior officer having worked only in the Customs stream and having no knowledge of Central Excise or Service Tax heads his seniors of Central Excise and Service Tax.
4. Such a horrible situation of humiliation and discrimination to work under an extreme junior happens only in the organization of CBEC which is neither justifiable by any rule of law or any principle of natural justice. It is further submitted that the Central Excise stream officers are by & large retiring after getting only 1 promotion in their service career (admitted by CBEC) after being recruited as Inspector while the Examiners of Customs are reaching the level of Addl. Commissioner (admitted by CBEC) and Commissioner after getting 5 or 6 promotions on account of the discriminatory rules.
5. On account of this discrimination, the officers recruited as Inspectors of Central Excise have also to draw less salary (even at the peak of their career) even than the pension of other analogous counterparts including intra-organisational counterparts of Customs, intra-departmental counterparts of CBDT, inter-departmental counterparts of CSS etc. recruited through the same competitive examination under same eligibility conditions and getting 5 to 6 promotions in their service career. Even the ACP or MACP Scheme is unable to undo this discrimination. The Central Excise executive officers are being discriminated despite of constituting about 50% of the total strength of the organization and playing the role of its backbone. Their counterparts of Customs are only 2.5% of the total strength and getting all the benefits due to faulty & biased rules.
6. As far as the ongoing cadre restructuring of CBEC is concerned, the 2006 Examiner shall enter group ‘A’ in 2012 and they shall further reach the level of Commissioner or Chief Commissioner while the Inspector of 1979 only will be able to enter group ‘A’ and retire as it is without further promotion. But very unfortunately, no care has been taken for the Central Excise stream officers either in the last cadre restructuring or in the ongoing one. The CBEC has itself admitted that even the fresh vacancies likely to arise as a result of cadre restructuring may not be able to resolve the problem. Even otherwise, no remedial steps are being taken to undo the injustice and discrimination done to the Central Excise executive officers.
7. On 25.10.11, it was presented to DOPT by CBEC that 1975 or before Inspector of Central Excise is working today as Superintendent after getting only 1 promotion while the Inspector of Income Tax and Assistant of CSS of that batch is working as Commissioner/Addl. Commissioner and Joint Secretary/Director respectively. Like that, it was presented that1986 Inspector of Central Excise is working today as only Inspector or Superintendent while the Inspector of Income Tax and Assistant of CSS of that batch is working as Deputy Commissioner and Under Secretary respectively. It was also presented that more than 9000 officers of Central Excise stream have got only 1 promotion after rendering 30 years of service. It was further presented that only the officer joining as Inspector of Central Excise in 1979 would be able to enter group ‘A’ JTS post provided all of the promotional vacancies are filled up by promotion.
8. However, one excellent thing happened in the last cadre restructuring for direct IRS officers. They were given parity with their counterparts of CBDT. One another excellent thing is going to happen in the ongoing cadre restructuring for them as they are going to get parity with the counterparts of other better placed group ‘A’ cadres. For other cadres also, all of the eligible officers will get promotions except Central Excise Executive category and their promotional vacancies will even remain unfilled due to the want of eligible candidates. The Association has no grudge against anyone of them including the IRS officers but it expects some excellent things for its members also. Their parity with the counterparts of CBDT was not even considered despite of the marking by the Hon’ble Finance Minister and the things were placed before him in mis-stated manner. It would have been really appreciable, if these officers were also ascertained to get parity with their counterparts of CBDT, CSS etc.
9. In view of the above, you are very much requested to look into the matter enabling the Central Excise executive officers to get parity in promotions with their common entry counterparts.

It was also presented that more than 9000 officers of Central Excise stream have got only 1 promotion after rendering 30 years of service. It was further presented that only the officer joining as Inspector of Central Excise in 1979 would be able to enter group ‘A’ JTS post after rendering 32 years of service provided all of the promotional vacancies are filled up by promotion.
8. It was also projected that the assessee base in respect of the Service Tax only would be 70 lacs in coming years. It means that we functionally require 14000 group ‘A’ entry level officers for effective, efficient and proper tax administration for Service Tax only earmarking one group ‘A’ entry level officer for 500 assessees. In addition to it, we require many thousands of additional group ‘A’ entry level officers for tax administration of Central Excise and Customs. But nothing is visible to create the required number of the said posts. The number of Shipping Bills, Bill of Entries, factory stuffing cases and number of passengers were projected to the tune of 57 lacs, 46 lacs, 18 lacs and 462 lacs respectively. It is also worth to mention that whole of the Customs work under the Central Excise jurisdictional area is being looked by Central Excise personnel. This functionally justifies the multifold number of vacancies at group ‘A’ entry level required for Central Excise stream officers. These Central Excise stream officers are looking after more than 80% of the Customs work in the country.
9. However, one excellent thing happened in the last cadre restructuring for direct IRS officers. They were given parity with their counterparts of CBDT. Another excellent thing is going to happen in the ongoing cadre restructuring for them in the form of parity with the counterparts of other better placed group ‘A’ cadres. For other cadres also, all of the eligible officers will get promotions as a result of ongoing cadre restructuring except Central Excise Executive category. The promotional vacancies for others will even remain unfilled due to the want of eligible candidates. The Association has no grudge against anyone of them including the IRS officers but it expects to happen some excellent things for its members also. Their parity with the counterparts of CBDT was not even considered despite of the marking by the Hon’ble Finance Minister and the things were placed before him in mis-stated manner. It would have been really appreciable, if these officers were also ascertained to get parity with their counterparts of CBDT, CSS etc.
10. As also admitted by the CBEC itself in its Board meeting of 12.01.11, the Director General of HRD was directed to suggest a scheme to eliminate the disparities in the promotions of the employees to give them equal opportunities for promotion to the group ‘A’ level. But nothing has been done in that direction till date.
11. The parity in promotions of the common entry level counterparts is the basic feature to give equal opportunities for promotions to the employees. Thus, the discrimination done to the Central Excise executive officers can only be undone by bringing all the counterparts of a particular year to the same level of promotion. This may easily be done with the mechanism of time bound promotions, notional promotions, creation of super-numeratory posts or any other measure/s as thought fit by the administration. It is also worth o submit that the CBEC itself recommended the mechanism of time scale after every 7 years as one of the measures to the 6th CPC for our group ‘B’ executive officers but the same CBEC did nothing in that regard in the latest cadre restructuring.
Nothing has even been done either in the last or ongoing cadre restructuring despite of the DOPT communications like D.O.No.5/26/2010-CS.II(A) Dt. 06.10.10, No. 19/1/2008-CS.I(P) Dt. 20.07.10, No. 20/51/2009-CS.II Dt. 27.01.11, No.35034/9/2010-Estt.(D) Dt. 10.02.11etc. stipulating very clearly that the cadre restructuring process should be viewed to mitigate the stagnation of the stagnated employees instead of functional requirement. The Association very firmly and the most humbly reiterates its demand of the parity in promotions with common entry counterparts. However if the parity in promotions of the common basic entry level officers is not possible in one go, first the parity in promotions of the feeder level officers may be attained and the 1987 recruitment rules may be restored for the time being.
12. It is, therefore, requested that the new recruitment rules may kindly be framed for the Inspectors & Superintendents of Central Excise considering the following qualifying services in consonance of the DOPT OM No. AB-14017/61/2008-Estt.(RR) dt. 24.03.09 –
(i) 2 years for promotion to a post with a grade pay of Rs. 4,800/- after joining as Inspector.
(ii) 7 years for promotion to a post with a grade pay of Rs. 6,600/- after joining as Inspector (There is no justification of promoting an officer from a grade pay of Rs. 5,400/- to 5,400/-. It is also mention-worthy that the most of the group ‘B’ gazetted officers including in CSS are being promoted to a senior group ‘A’ post instead of junior group ‘A’.).
(iii) 12 years for promotion to a post with a grade pay of Rs. 7,600/- after joining as Inspector.
(iv) 17 years for promotion to a post with a grade pay of Rs. 8,700/- after joining as Inspector.
(v) 18 years for promotion to a post with a grade pay of Rs. 8,900/-after joining as Inspector.
(iv) 20 years for promotion to a post with a grade pay of Rs. 10,000/- after joining as Inspector.
(v) 23 years for promotion to the HAG after joining as Inspector.
(vi) 24 years for promotion to the HAG + Scale after joining as Inspector.
(vii) 26 years for promotion to the HAG Apex Scale after joining as Inspector.
(viii) 27 years for promotion to the HAG + Apex Scale after joining as Inspector.
In addition to the above qualifying services particularly keeping in view the most stagnated state of the Central Excise stream officers, there should kindly be incorporated the permanent provisions in the recruitment rules at every level to promote the officer automatically to the next higher grade, if his/her stagnation in a grade reaches one & half times of qualifying service. It may also kindly be ascertained in the recruitment rules that a direct recruit Inspector of Central Excise is not retired before entering PB4 pay band.
13. In view of the above, you are very much requested to look into the matter enabling the Central Excise executive officers to get parity in promotions with other counterparts.

With due regards, your kind attention is invited to the Report of the Committee constituted to look into the representations and demands of the Group ‘B’ and ‘C’ Executive staff of Customs, Central Excise & Income Tax relating to their pay-scale disparity and other grievances arising out of the recommendations of the 5th pay Commission. In accordance with such report, the job contents and nature of duties of the post of Superintendent of Central Excise are similar to the posts of Chief Enforcement Officer of Enforcement Directorate, Superintendent of NCB, UT Civil and Police Services (DANICS & DANIPS), Deputy Central Intelligence Officer in IB and DSP in CBI etc.
2. Your kind attention is also invited to the para 7.15.24 of the 6th CPC report, wherein the VI CPC has stated that “The post of Chief Enforcement Officer has traditionally been on par with the post of ITOs/analogous posts in CBDT and CBEC. Since the parity between these posts is well established, the Commission recommends that the same should be maintained in future.” The Chief Enforcement Officers were placed in the pay scale of Rs. 7500-12000/- since 01.01.96 and 8000-13500/- since October,05. Later on, they were re-designated as Asstt. Director to give them powers of the level of Asstt. Commissioner.
3. The VIth CPC has also recommended the parity between headquarters organization and the field offices vide chapter 3.1 of its report.
4. Despite such recommendations of VI CPC, the Grade Pay of the Superintendent of Central Excise has been fixed to Rs. 4800/- in PB-2 (for those completing less than 4 years ) and 5400/- in PB-2 (for those completing more than 4 years) w.e.f 01.01.06. But a Grade Pay of Rs. 5400/- has been fixed for Chief Enforcement Officer of Enforcement Directorate, Deputy Central Intelligence Officer in IB and DSP in CBIetc.
5. In accordance with the Recruitment Rules for the post of Asstt. Director/Chief Enforcement Officer in Enforcement Directorate & DSP in CBI etc., the post of Superintendent of Central Excise is considered as an analogous/equivalent post. Due to this reason, they are also being considered to be posted as Asst. Director/Chief Enforcement Officer in Enforcement Directorate & DSP in CBI etc. on deputation basis.
6. It is also submitted that the Jabalpur CAT had directed the government in O.A. No. 541/94 to pay the arrears of pay to the Inspectors of Central Excise w.e.f. the date of enhancement of pay scale of the Inspectors of CBI, if both of the categories were granted the same pay scale by the 5th CPC. The 5th CPC placed both of the categories in the same pay scale but the payment of the arrears to the Inspectors of Central Excise is still awaited. All of then Inspectors of Central Excise have already become Superintendents but waiting for the payment of the arrears. It is, therefore, requested that the concerned authorities may kindly be directed to make the due payment at its earliest. It is worth to submit that the said arrears were not paid despite of the acceptance by the Ministry of Law.
7. It is, therefore, requested that the post of Superintendent of Central Excise may kindly be granted with a Grade Pay of Rs. 5400/- in PB-3 w.e.f. the date of the enhancement of the pay scale of above mentioned counterparts of them and the payment of the arrears may also kindly be made as requested in above para 6.

No.16/26/2004-Ad. 1C dated 04.10.05. Later on, they were re-designated as Asstt. Director to grant them the powers of the Asstt. Commissioner.
4. Despite such recommendations of VI CPC, the Grade Pay of the Superintendent of Central Excise has been fixed to Rs. 4800/- in PB-2 w.e.f 01.01.06 while a Grade Pay of Rs. 5400/- has been fixed for Chief Enforcement Officer of Enforcement Directorate, Deputy Central Intelligence Officer in IB and DSP in CBI etc.
5. In accordance with the Recruitment Rules for the post of Asstt. Director/Chief Enforcement Officer in Enforcement Directorate & DSP in CBI etc. and as per the definition of analogous post vide O.M. No.14017/27/75-Estt(D) (Pt.) Dt. 07.93.84 of Ministry of Home Affairs (Department of Personnel & Administrative Reforms) also, the post of Superintendent of Central Excise is considered to be an analogous/equivalent post to the counterparts of CBEC, NCB, IB, CBI, Enforcement Directorate etc. Due to this reason, they are also being considered to be posted as Asst. Director/Chief Enforcement Officer in Enforcement Directorate & DSP in CBI etc. on deputation basis. They should, therefore, be given equal treatment in the matter of pay etc. It is also well pertinent to mention that the counterparts of IB, CBI etc. have already been placed under a replacement scale of Rs. 8,000-13,500/- in PB3.
6. Even more, the government has also enhanced the pay scale of the Inspectors of Central Excise (the cadre being supervised by the Superintendents) and other equivalent cadres to a scale with initial pay of Rs. 7,450-/- from Rs. 6,500-/- with all the consequential benefits w.e.f. 01.01.06. This has left an initial difference of only Rs. 50/- in the pay scales of the supervised cadre of Inspector and supervising cadre of Superintendent while this difference is Rs. 2,000/- or more in the case of other higher as well as lower cadres.

Madam,
Kindly refer to the various communications of the Association addressed to the administration including Ref. No. 163/11 Dt. 12.09.11, 139/11 Dt. 16.08.11, 102/11 Dt. 6.07.11, 100/11 Dt. 01.07.11, 91/11 Dt. 22.06.11, 85/11 Dt. 08.06.11, 71/11 Dt. 20.05.11 etc. as well as the thankful initiative taken by the Board in the matter vide letter F.No. A-32021/42/2011-Ad.II Dt. 01.11.11 asking for the relevant information from the field formations till 25.11.11.
2. It is further submitted with due regards that your goodself is already aware of the retirement of a good number of our officers every month without promotion. At least 5 officers out of the list enclosed with the above referred letter Dt. 01.11.11 of CBEC have already retired last month and at least 8 are going to retire this month.
3. It is also submitted that no direct recruitment would be made for more than 2 years as per the decision taken during the presentation made on the cadre restructuring on 18.01.11. After that also; the minimal direct recruitment would only be made, if et al required. Moreover, the Hon’ble Supreme Court has given the directions to remove the disparities in promotions to group ‘A’ from group ‘B’ on 03.08.11 implying that more number of vacancies would be given to Central Excise after reviewing all the ad hoc promotions on the basis of new Recruitment Rules. It is, therefore, requested that all the vacancies against retirements for coming at least 2 years may be calculated and given to the Central Excise personnel in addition to the existing vacancies and the DPC may be held accordingly.
4. In view of the above and also keeping in view the acute stagnation of the officers, it is requested that the matter of the promotions against existing vacancies of Asstt. Commissioner may kindly be expedited and the promotions may be materialized at an early date without further retirements from the list enclosed with the letter F.No. A-32021/42/2011-Ad.II Dt. 01.11.11. The Association was very hopeful that these promotions would certainly be materialized in the month of December’11, if not in November’11.
