PIO denied information on promotion- Penalty imposed by the Appellate Authority

Constitution - Administrative - Right to Information Act, 2005 - Appellant sought certain information regarding an order issued by the respondent department in relation to promotion - PIO replied that the information had not been come under the purview of the Act - Appellant filed first appeal - However, First Appellate Authority replied that it had not yet received any order - Appellant filed second appeal on the ground that PIO had provided unsatisfactory and incomplete information - Held, PIO was directed to provide the information to the appellant as per available records - PIO failed to furnish the information within the specified time and failed to show a reasonable cause for the delay of 84 days in providing information - Hence, penalty was imposed on PIO for not providing information within the stipulated time - Appeal allowed.
