Success of the struggle of the team in getting the grade pay of Rs. 5400/- to Inspectors who have completed 4 years regular service in the grade pay of Rs. 4800/-

Dear friends,
Initially the CBEC had rejected the demand on the ground that the benefit was not meant for the officers who were granted the grade pay of Rs. 4800 by way of ACP but the Association again argued that the criterion for granting the benefit of grade pay of Rs. 5400/- are;-
(1). The incumbent should be a Group "B "officer
(2). He should have completed four(4) years of regular service in the scale of 7500-12000 (grade pay of Rs.4800/-)
In terms of Board’s Order F.No. O-8013/100/2003-IHB dated 11.12.03 & 24.10.07 read with DOP&T’s Instructions/Notification S.O.No. 332 dated 20.04.98, the post of Inspector, Central Excise under the CBEC was reclassified as Group B (Non Gazetted) post w.e.f 11.12.03. Therefore, since in Point No. 1(x)d of the Resolution of the Government of India dated 29.08.08 in respect of the recommendations of the sixth CPC only the term ‘Group B officer’ has been mentioned, an Inspector of Central Excise who is a Group B officer and has been granted the scale of 7500-12000 by virtue of ACP should be eligible for getting the higher grade pay of Rs. 5400/- on his completing 4 years of regular service in the scale of 7500-12000 (attributed with a grade pay of Rs. 4800/-) in the same manner as a Superintendent of Central Excise gets the said grade pay. So there should not be any bar in getting the revised benefit granted to that scale on a non-functional basis.
Thereupon board decided to forward the file to DOPT for a clarification. On 5th of November, 2008 board had asked for detailed reasoning in support of the demand. The matter was discussed in the general meeting dated 5.11.2008 which was held at our Jaipur Hqrs Lawn and was also addressed by the Secretary General Mr. KOUSIK ROY. Thereafter, a letter was prepared in the Service Tax Division Jaipur and the same was faxed and mailed by the SG to Board.
The Board has clarified vide letter F.No. A-26017/98/2008-Ad II.A dt. 21.11.2008 that officers who are posted in the 7500/- pay scale shall be eligible for grant of grade pay of Rs. 5400/- after 4 years continuous service in that scale / grade pay. The said clarification has already been made available to the members at our website also.
Now, revised orders for fixation of pay with grade pay of Rs.5400/- to the Inspectors, who have completed 4 years service in the scale of Rs. 7500-250-12000 have been issued in many commissionrates. Copies of such orders of fixation are available with us. We have also distributed the same to many members. We are also requesting the concerned authorities to start issuing orders granting this grade pay to the eligible officers immediately. Eligible members are requested to ask the concerned AO/PAO to get their fixation in the grade pay of Rs. 5400/-. All the officers upto the 1992 batch have become eligible for this benefit in April,2008 while the officers belonging to 1993 batch will become eligible from next month i.e. January 2009. Hence, request letters may be sent immediately so that the salary for the month of December 2008 is drawn correctly alongwith arrears for the period upto November 2008. Minimum benefit on this account will be Rs. 2552 per month and minimum amount of arrears will be around Rs. 20,000.
I would like to thank our All India Office Bearers for their diligent efforts in this regard. I also appreciate the role played by the general members who contributed /extended their Co-operation and guidance for the communications made to achieve the clarification.
Friends, this is not the end of our battle for getting the due benefits rather it is only a beginning and we are actively involved in pursuing the matter of grant of ACP benefits to promotee officers on completion of ten years service in the grade of Inspector and grant of the pay scale of Rs. 7450 to al Inspectors consequent upon merger of the old pay scales of Sr. T. A. and Inspectors. The matter is being pursued regularly and and we hope to get the orders by next month positively.

Well first of all wish u a very happy new year dear friends! now please stop clapping and self praise and fight for right- still at least in rajasthan ie jaipur not even a single acp inspector 9i.e. 1991,1992 batch)have been given grade pay of 5400/-!concerned clerks/ao's/cao's/ddo's are acting like ostriches!why justice delayed is justice denied!please take united stand and action against this injustice and its immediate rectification-
ye article 10 saal pehle likha gaya tha. Par abhi tak nahi mil raha hai. Hon'ble SCI se ordar hone ke baad bhi general order nahi aaya ab tak. Jisko lena ho wo pehle cat me case file kare//////////////////////////////..................
